This lawsuit was long overdue. I think Barry's strategy is to use the legal system to prevent the authors of 'Game of Shadows' from profiting from the book since the book is based on information illegally obtained, in other words, obtained fraudulently.
If he eventually wins this lawsuit, it will provide him with a stronger case to sue for libel. It is likely that he will go after SF Chronicle, SI & the publishers of the book. The potential for punitive damages will be massive.
